A Trademark is a work, phrase, symbol or design, or combination of words, phrases, symbols or designs, which identifies and distinguishes the source of the goods or services on one party from those of others. These include words, slogans, colors, sounds, pictures and other symbols.
Protection in Canada is 15 years and is renewable for 15-year periods as long as the mark is in use. In the US, the same rule applies but in 10-year increments.
3-steps for processing and filing a trademark
1 - Opening a file
To open a file, we work with what we call an inventor’s kit. The kit which includes our official confidential disclosure form comprising of a pre-signed confidentiality agreement from the President which guarantees that your file is treated with total confidentiality. Open a file (click here)
There is a charge of $25 + taxes for the kit.
2 - The search for availability of your trademark
The search for availability aims at checking if the mark you wish to protect is already used or if it could potentially lead to confusion with another mark already registered. A search report which includes relevant trademarks and the recommendations of the evaluator will be submitted to you.
3 - Registering the trademark
With the results of the search report in hand, if yu decide to register the trademark, we will proceed to compile the documents that are necessary for registration in the Canadian and/or US trademark offices based on your request.
